Terms and Conditions of Sale

Article 1 — Scope of Application
These General Terms and Conditions of Sale (hereinafter referred to as "GTC") apply, without restriction or reservation, to all sales concluded by the Seller with non-professional buyers wishing to purchase products offered for sale on the website www.boraia.shop. The Products offered for sale are as follows: sunglasses.
The choice and purchase of a Product are the sole responsibility of the Customer. Product offers are subject to stock availability.
These GTC are accessible at any time on the website and shall prevail over any other document. The Customer declares having read and accepted them by checking the box provided for this purpose before placing the order.

Products are offered for sale in the following territory: La Réunion.
Article 2 — Price
Products are supplied at the current rates displayed on the website when the order is registered. Prices are expressed in euros, excluding tax and including tax.
These rates are firm and non-revisable during their validity period, but the Seller reserves the right, outside of the validity period, to modify prices at any time.
Prices do not include processing, shipping, transport, and delivery costs, which are charged extra and calculated prior to placing the order.
An invoice is issued by the Seller and given to the Customer upon delivery.
Article 3 — Orders
- The Customer chooses a product and adds it to their cart.
- They decide to purchase it.
- They provide their address and choose a delivery option.
- They pay and receive their order.
The sale will only be considered valid after full payment of the price. It is the Customer's responsibility to verify the accuracy of the order and to report any errors immediately.
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding the payment of a previous order.
Article 4 — Payment Terms
Payment is made via a secure payment method, by bank card, in cash and in full on the day the order is placed.
Payment data is exchanged in encrypted mode using the protocol defined by the approved payment provider. Payments will only be considered definitive after actual receipt of the amounts due.
Article 5 — Deliveries
Products will be delivered to La Réunion, to the address indicated by the Customer when placing their order.

- Beyond Saint-Pierre to Saint-Joseph: €6.99
- From Saint-Joseph to Saint-Philippe: €9.99
- From Saint-Benoît to Saint-Philippe: €10.99
Express delivery
- West: €8.99
- North and South: €10.99
- East: €16.99
Meeting point — twice a month in Sainte-Marie and Saint-Pierre. Free.
If the Products have not been delivered within 3 weeks after the indicative date, for any reason other than force majeure or the Customer's fault, the sale may be cancelled at the written request of the Customer under the conditions provided for in articles L.216-2, L.216-3 and L.241-4 of the Consumer Code.
The Customer has a period of one month from delivery to submit claims by email, accompanied by all supporting documents (especially photos).
Article 6 — Transfer of Ownership
The transfer of ownership will only take place after full payment of the price, regardless of the delivery date.
Article 7 — Right of Withdrawal
The Customer has a period of 14 days to exercise their right of withdrawal, in accordance with the provisions of article L.221-18 of the Consumer Code.
Returns must be in their original and complete condition (packaging, accessories, instructions), allowing them to be remarketed in new condition, accompanied by the purchase invoice. Damaged, soiled or incomplete Products will not be accepted.
Return shipping costs remain the responsibility of the Customer.
The exchange or refund will be made within 14 days of receipt of the returned Products.
Article 8 — Seller's Liability, Warranties
The Products supplied by the Seller benefit from the legal guarantee of conformity and the legal guarantee against hidden defects.
Article L.217-4 of the Consumer Code: "The seller is obliged to deliver goods that conform to the contract and is liable for any non-conformity existing at the time of delivery."
Article L.217-12 of the Consumer Code: "The action resulting from non-conformity lapses two years after delivery of the goods."
Article 1641 of the Civil Code: "The seller is bound by a warranty against hidden defects in the item sold that render it unfit for the use for which it was intended."
Article 1648, first paragraph, of the Civil Code: "The action resulting from redhibitory defects must be brought by the buyer within two years of the discovery of the defect."
The Seller's liability cannot be engaged in case of misuse, negligence or lack of maintenance by the Customer, normal wear and tear, accident or force majeure.
The photographs and graphics presented on the website are not contractual.
Article 9 — Personal Data
The collection of personal data is necessary for the sale of Products and their delivery. This data is collected solely for the execution of the sales contract.
Retention period: 5 years. Recipients: sole use of the Seller. See the privacy policy.
Article 10 — Intellectual Property
The content of the website is the property of the Seller and its partners. Any total or partial reproduction is strictly prohibited.
Article 11 — Applicable Law, Language
These GTC are governed by and subject to French law, and written in the French language.
